Chief Justice of India BR Gavai has promised to reconsider the prohibition on stray dogs in the streets of Delhi-NCR in response to significant public outcry. On Monday, the Supreme Court mandated the relocation of all stray dogs from residential areas to shelters due to an increase in dog bites and rabies incidents, which elicited varied responses. Resident Welfare Associations (RWAs) expressed their support for the ruling, while animal rights activists contended that municipal authorities lacked the financial resources necessary for such a relocation initiative. This matter was brought to the attention of the Chief Justice this morning, who was also informed of a prior court ruling that prohibited the relocation and euthanasia of stray dogs, emphasizing adherence to existing regulations. “I will look into this,” the Chief Justice responded, raising the hopes of numerous animal advocates who disagreed with the Supreme Court’s stance on the necessity of moving dogs off the streets of Delhi-NCR. The counsel referenced a May 2024 ruling by a panel led by Justice JK Maheshwari, which had directed similar petitions to High Courts and remarked, “Exhibiting compassion to all living beings is a Constitutional value.”

The order issued on Monday was made by a panel of Justices JB Pardiwala and R Mahadevan, who acknowledged media reports regarding the surge in dog bite incidents. “We need to take action using whatever means necessary to ensure a dog-free environment, as this will enhance the safety of children and the elderly,” the bench stated, clarifying that no petitions from dog enthusiasts or any other parties would be entertained. “We are not doing this for ourselves. It is for the public good. Therefore, no emotional considerations should influence this matter. Prompt action is required,” Justice Pardiwala asserted. The ruling sparked a significant backlash from civil society, including responses from celebrities ,politicians and public.
